Welcome to Verse Zine, a service provided by Subcreation Design, LLC ("Verse Zine," "we," "us," "our"). By creating an account, purchasing credits, or downloading any assets from our service, you agree to be bound by these Terms and Conditions ("Terms").

- Human-Led Curation: Our entire library is the product of a unique, human-led art direction process. By using our service, you acknowledge and agree to the nature of our curated assets.
- You Own Your Creations: You own your new creative works that incorporate our assets, subject to the license terms.
- Recurring Billing: Your subscription renews automatically. You can cancel anytime to stop future charges.

1. The Service
Verse Zine provides a subscription-based service that allows members to license and download high-quality, royalty-free digital image assets ("Assets") from our curated collection. The service is accessed through our website (versezine.com).
2. Accounts & Subscriptions
- Account Creation: You must create an account to use our service, providing accurate and current information. You are responsible for safeguarding your password and for all activities that occur under your account.
- Subscription Plans: We offer one or more subscription plans that provide a specific number of download credits each month ("Credits"). An active subscription is required to download Assets.
- Credits: To download an Asset, you must redeem one or more Credits as indicated on the Asset's page. Monthly subscription Credits roll over and are valid for up to six (6) months from their date of issue, after which they will expire. Upon cancellation or termination of your subscription, all remaining Credits will be forfeited at the end of your final billing period.
3. Payments, Cancellations, and Refunds
- Billing: All payments are processed through third-party processors, including Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. Your subscription will automatically renew unless you cancel prior to the renewal date.
- Price Changes: We reserve the right to modify our subscription pricing. For any price changes affecting existing subscribers, we will provide at least 30 days' notice.
- Cancellation: You may cancel your subscription at any time through your account settings. The cancellation will become effective at the end of your current paid-up billing period, and you will not be charged again.
- No Refunds: Payments are non-refundable and there are no refunds or credits for partially used periods.
4. License Grant & Restrictions
Subject to your compliance with these Terms and payment of all applicable fees, upon redeeming Credit(s) for an Asset, Verse Zine grants you a worldwide, perpetual, non-exclusive, royalty-free license to use, reproduce, modify, and display the Asset according to the terms below.
4.1. Permitted Uses. You are permitted to:
- Use the Asset for any commercial or personal project, including in advertising, marketing, websites, social media, presentations, print media, and product packaging.
- Modify, edit, crop, and create derivative works based on the Asset.
- Use the Asset in projects for your clients. The license covers the client's use of the final, completed work, but does not permit you to transfer the raw Asset file to the client for their separate use.
- Reproduce the Asset without any limits on audience size, viewership, or number of print runs.
4.2. Prohibited Uses. You are expressly prohibited from doing any of the following:
- Reselling, sublicensing, sharing, or otherwise distributing the standalone Asset file, whether modified or not. This includes making the Asset available through any other stock media platform, as an NFT, or as a downloadable file.
- Using the Asset as the primary value-driver of a product intended for resale, such as in a print-on-demand service (e.g., t-shirts, mugs, posters) or a digital template (e.g., website themes, Canva templates) where the end-user can easily extract the Asset.
- Using the Asset as part of a trademark, service mark, or business logo.
- Using the Asset for any unlawful, defamatory, or pornographic purpose.
- Using the Asset to train, fine-tune, or supply data to any artificial intelligence or machine-learning model.
- Claiming authorship of the Asset in its original or substantially unmodified form.
4.3. License Type. The license granted is a single-user license. It is personal to you, the subscriber. It may not be shared or used by other individuals, including other members of a team or company. Each individual user requiring access to the Assets must have their own active subscription.
4.4. Attribution. Attribution is not required for most uses. However, for any use in a film, television, or video game production that includes a section for credits, you must provide the following credit in that section: Imagery licensed from Verse Zine (versezine.com). You also agree to notify us via email at [attribution@versezine.com] of any such credited use.
We reserve all rights not expressly granted to you in these Terms. A breach of these license terms shall be considered a material breach of this Agreement.
5. Intellectual Property & Source of Assets
- Our Intellectual Property: All content on our website, including the website design, text, logos, and the arrangement of our Assets, are the exclusive property of Verse Zine and are protected by intellectual property laws.
- Source of Our Assets: Verse Zine is committed to providing unique, distinctive visuals. Our library is the result of a proprietary creative process that involves human-led art direction utilizing advanced generative AI tools. Our creative director's extensive experience and artistic input—in conceptualizing, steering the aesthetic, iteratively refining, and curating the final images—is what defines the Verse Zine collection.
- Your Acknowledgement: By using our service and downloading Assets, you acknowledge the nature of our creative process. You agree that the value and licensability of an Asset are based on its final form as presented by Verse Zine, regardless of the tools used in its creation. You hereby waive any future claim against Verse Zine related to the origin of the Assets, provided they are used in accordance with the license granted herein.
6. User Content & Responsibilities
- Your Creations: You retain all rights to the new and original creative works that you produce using our Assets ("User Content"), subject to your adherence to the license restrictions outlined in these Terms. We claim no ownership over your User Content.
- Legal Compliance: You are solely responsible for your use of downloaded Assets and for ensuring that your User Content complies with all applicable laws and regulations in your jurisdiction.
7. Service Availability & Modifications
- Service Changes: We reserve the right to modify, suspend, or discontinue any aspect of our service at any time. We will provide reasonable notice for significant changes affecting existing subscribers.
- Content Removal: We may remove Assets from our library at our discretion. This will not affect the license for any Asset you have already downloaded.
- Technical Requirements: Our service requires a stable internet connection and a modern web browser. We do not guarantee compatibility with all devices or software.
8. Disclaimers and Limitation of Liability
- THE SERVICE AND ASSETS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VERSE ZINE, ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
- IN NO EVENT SHALL THE AGGREGATE LIABILITY OF VERSE ZINE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID VERSE ZINE, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless Verse Zine from any claims, damages, liabilities, and expenses arising out of your use of the Service or your breach of these Terms.
10. Termination
We may suspend or terminate your account and access to the Service for any material breach of these Terms, with or without notice.
11. General Provisions
- Governing Law: These Terms shall be governed by the laws of the State of Washington, without regard to its conflict of law provisions.
- Dispute Resolution: Any dispute arising from these Terms shall be resolved through final and binding arbitration in King County, Washington.
- Changes to Terms: We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with notice, such as by sending an email or displaying a prominent notice on our website.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
